Coastal Media: Master Terms & Conditions

1. Scope of Terms

  • These Terms apply to any individual, business, or organization (“Client”) that engages Coastal Media for professional services.
  • The Client’s use of any deliverable or intellectual property provided by Coastal Media constitutes immediate acceptance of these Terms & Conditions.
  • Should a specific wedding contract or service agreement be signed, these Terms apply in conjunction with that agreement unless explicitly overridden in writing.

2. No Refund Policy

  • Strict No-Refunds: Coastal Media maintains a strict no-refund policy on all services and projects once payment is received and work has commenced.
  • Resolution: In the event a Client is unsatisfied, we will endeavor to resolve issues amicably; where appropriate, a credit for future services may be issued.

3. Ownership of Creative Work & Intellectual Property

  • Intellectual Property: All creative work produced—including photography, videography, website/app code, and digital assets—remains the exclusive property of Coastal Media under the South African Copyright Act.
  • License of Use: Clients are granted a non-exclusive, non-transferable right to use the content for its intended personal or business purpose.
  • Software Licenses: Third-party software or plugins purchased on behalf of the Client remain the property of Coastal Media. Continued access may require an active service relationship.

4. Payment Terms

  • Booking Deposit: A 50% non-refundable deposit is required to secure any booking date.
  • Wedding Milestones: 50% deposit at booking; 25% payable within 7 working days after the wedding; 25% due upon final delivery.
  • Monthly Invoicing: Corporate invoices are issued on the 25th of each month and are due on the 1st day of the following month.
  • Late Penalties:
    • Wedding balances not settled within 7 days of delivery incur a fee of R500.00 per day.
    • Corporate invoices incur a 2% monthly interest fee.

5. Confidentiality & POPI Act Compliance

  • Data Protection: We uphold compliance with the Protection of Personal Information Act (POPIA) when collecting and processing client data.
  • Usage: Personal data is used solely for project coordination, billing, and internal record-keeping to deliver our services.
  • Email Privacy: Content from @coastalmedia.co.za or @hammer360.co.za is confidential and intended solely for the recipient. Unauthorized sharing is strictly forbidden.

6. Limitation of Liability & Outages

  • Service Interruptions: Coastal Media is not liable for unplanned outages or performance issues arising from third-party providers (e.g., hosting or Google Drive).
  • Equipment Damage: The Client accepts full liability for any damage or theft of Coastal Media equipment caused by guests, staff, or third parties.
  • Maximum Liability: Any established liability is limited to the amount paid for the specific service in question.

7. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of South African courts.
